The most common and difficult legal problem facing the average Californian is divorce.  Over 50% of all marriages eventually break-up.  Although divorce is a very difficult situation, it doesn’t also have to be a financial disaster.

In California we have what is known as “no-fault divorce”.  What this means is that, unlike the old days, the married couple does not have to plead, or prove, “grounds” for divorce.  So having to prove “infidelity”, or “mental cruelty”, or the like, is now strictly in the garbage pile of history and old television programs.  In California one party merely has to state that “irreconcilable differences” have arisen and that is all.  Then the only issues are dividing the marriage property and debts, providing for the custody and visitation of any children under 18 and the support of either the husband, or the wife, if need be.

California is a “community property” state.  This means that everything accumulated during marriage is one half the property of the wife and one half the husband.  Sometimes this can lead to complex issues of who owned what, when, and who should get what, when the property is divided.   It is also the policy of California that people who had been married should take all reasonable steps to become self supporting as soon as they can.  But this means that the notion of “alimony” or as it is known in California “spousal support” is still alive and well.
